Do I have to start a lawsuit within a certain period of time after my accident?
You must sue within two years, or your claim ceases to exist. Two exceptions to this rule are if the injured person is:
- under nineteen years of age, or
- mentally incompetent.
When someone under nineteen is injured in an accident, he or she must sue within two years of turning nineteen. If, however, the guardian of that person receives a written notice that the two-year limitation period has begun and the notice meets the requirements of the Limitation Act of B. C. , the two years begins from the date the notice was delivered.
If a person is incapable of, or substantially impeded in, managing his or her affairs, then the two-year limitation does not begin until the person ceases to be under this disability.
